The lawsuit alleges that Bayside Cemetery and Congregation Shaare Zedek misappropriated funds meant for the perpetual care of lots, plots, mausoleums, and graves at Bayside Cemetery. Both parties deny any wrongdoing.

You are part of the Settlement Class if you purchased or paid for a perpetual care contract from Bayside Cemetery and/or Congregation Shaare Zedek. Certain exclusions apply as detailed in the Notice.

 

Bayside Cemetery and Congregation Shaare Zedek have agreed to maintain a $6.5 million Reserve Fund to use the interest income for cemetery maintenance. If approved by the Court, this will be binding for all Settlement Class Members.

If you wish to exclude yourself and retain the right to file your own lawsuit or be involved in other legal actions against Bayside Cemetery and Congregation Shaare Zedek about the issues in this case, you need to send a letter requesting exclusion from the Settlement postmarked no later than April 16, 2025.

To exclude yourself, send a letter with the following details:

  • Your name, address, and telephone number.
  • A statement indicating you are a member of the Settlement Class and wish to be excluded from the Settlement in Leventhal v. Bayside Cemetery and Congregation Shaare Zedek, Index No. 100530/11.
  • Your personal signature (attorney signatures are not sufficient).

Mail your exclusion request, postmarked no later than April 16, 2025, to the following address:

If you exclude yourself, you will not receive any benefits from this Settlement, but you will have the right to pursue separate legal claims.

If you oppose the proposed Settlement and wish to remain in the Settlement Class, you can file an objection. Your objection should include:

  • The name of the case: Leventhal v. Bayside Cemetery and Congregation Shaare Zedek, Index No. 100530/11.
  • Your full name, address, and telephone number.
  • A statement clarifying whether the objection applies to you, the entire Settlement Class, or a subset.
  • An explanation of why you consider yourself a member of the Settlement Class.
  • All grounds for objection, providing any legal support for your objections.
  • The identity of counsel, if any, representing you in this objection.
  • A statement indicating whether you or any of your counsel want to appear at the Final Approval Hearing.
  • A list of any individuals you plan to have testify at the Final Approval Hearing in support of your objection.
  • Your personal signature (not your attorney's).

Send your objection, postmarked no later than April 16, 2025, to the Court's address as well as to the attorneys representing the parties involved as detailed in the Long-Form Notice.

 

No, the Settlement Class is represented pro bono by Michael M. Buchman of Motley Rice LLC. However, you can hire your own lawyer at your own expense if you wish.

If you do nothing, you will remain part of the Settlement Class and be bound by the Court's final decision. You will not be able to sue Bayside Cemetery or Congregation Shaare Zedek separately for these claims.
